Terms of use

These terms apply to the website at nativetongue.io and to software published by Native Tongue LLC ("we", "us"). By using either, you agree to them. If you do not agree, do not use them.

Licence

We grant you a personal, non exclusive, non transferable licence to use our software on devices you own or control, for as long as these terms are in force. We keep ownership of the software and of everything in it. You may not copy, resell, rent, reverse engineer, or attempt to extract the source of our software, except where the law says you may despite this clause.

Your content

Text you enter stays yours. You give us only the permission needed to run the service for you: to process your text so that a translation, analysis, or spoken audio can be returned, and to store your material on your device. We do not claim ownership and we do not use your content to advertise to you.

You are responsible for what you put in. Do not use our software to break the law or to process material you have no right to.

Purchases and subscriptions

Purchases made through the App Store are transactions with Apple under Apple's terms. Subscriptions renew automatically until cancelled, and are cancelled through your Apple Account settings rather than through us. Refunds for App Store purchases are issued by Apple through reportaproblem.apple.com. If you think you have been charged in error, contact us and we will help.

Accuracy

Our software produces machine translation and machine generated grammar explanations. These are learning aids. They will sometimes be wrong. Do not rely on them for medical, legal, financial, or safety critical purposes, or for anything where a mistranslation would cause harm.

Availability

We may change, suspend, or discontinue features, and we depend on third party services that can themselves fail or change. We do not promise uninterrupted availability. Where a change materially reduces what a paid plan offers, contact us and we will sort out a fair outcome.

Warranty and liability

Our software is provided "as is" and, to the fullest extent the law allows, without warranties of any kind, whether express or implied, including fitness for a particular purpose. To the fullest extent the law allows, our total liability arising out of or relating to these terms or the software is limited to the amount you paid us for it in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential loss.

Nothing here limits liability that cannot legally be limited, including liability for fraud or for death or personal injury caused by negligence. If you are a consumer, you keep the statutory rights your local law gives you and nothing in these terms takes those away.

Ending these terms

You may stop using our software at any time by deleting it. We may end your licence if you materially breach these terms. Sections that by their nature should survive, including ownership, warranty, and liability, survive the end of these terms.

Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Any dispute arising out of them may be brought in the state or federal courts located in Wyoming, and you and we agree to the jurisdiction of those courts.

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law gives you the right to bring proceedings locally and to the protection of mandatory consumer rules, this clause does not take that right away from you.

Changes

We may update these terms. The date at the top of the page shows when they last changed. Continuing to use the software after a change means you accept the updated terms.
